Bruce’s Summary: Just to give you an idea of how complicated California employment matters have become let’s look at something that seems so innocent and simple – an employee requesting copies of their personnel file. The author sites recent laws (three in particular) amended by the California legislature affecting employee rights in getting access to their “employee records” and employer potential liability and penalties if not delivered (with two laws being potential criminal infractions and one a misdemeanor) in a specific time period. It’s good to be aware of each of the laws and the author presents an excellent overview to tweak ones curiosity. For HR Professionals, it a great overview for sharing with their teams and use as a check-off list (devils in the details) before the email/official letter comes from the employee and/or their representative demanding such.
