Bruce’s Summary:  Interesting court decision from the Fourth Circuit – Now more than ever, employers must take all complaints of inappropriate behavior in the workplace seriously.  Proper HR training and expanding management training to those employees perceived as “quasi-supervisors” is primary.  But if a complaint is made, an investigation that is compliant with HR regulatory should immediately follow. Then the employer must take timely action where appropriate. Lastly, although it shouldn’t have to be said, “Never punish an employee for complaining in good faith.” Although, you may not be in the Fourth Circuit, it’s a good sign of what’s coming.  “None of the information contained herein should be construed as legal advice, nor are Calvin Associates consultants engaged to offer legal advice.
