Bruce’s Summary: If you wanted an example of what not to do in relation to I-9 compliance, I think we found one. The Immigration and Customs Enforcement (ICE) uses inspections as a key enforcement tool and hands out high level fines to build a “culture of compliance.” ICE is trying to get our attention but in this case this organization appears to have totally missed it. It became costly for them. Audit your I-9 files and make sure the basics are covered. According to this article the fines are imposed to “have a deterrent effect on an employer’s behavior and not merely be a cost of doing business,” as in the past. “None of the information contained herein should be construed as legal advice, nor are Calvin Associates consultants engaged to offer legal advice.
