Bruce’s Preview: When an employee submits a certification for leave in compliance with FMLA the employer is faced with a decision to grant to the leave or not.  If the employee’s FMLA certificate clearly indicates that no leave is needed or the employee is clearly not entitled to leave the employer, may not have to obtain more information from the employee. However, if the certificate indicates any length of leave is needed but does not provide complete information as to why – the employer should give the employee a 7 day period to provide additional information.
